Proportionally, the Tax Is the Big Number

What Is the Specific Thing to Watch For?

A letter from the county assessor asking you to complete a Residential Property Declaration. It gets sent when the mailing address stops matching the property address, which is what happens the moment you redirect post after a fire. Section 59-2-103.5(8) gives 90 days from the letter's date, and some counties will remove the exemption if the form is not returned within 30 days of notice. It does not look urgent and it is.

Redirected Post Is the Mechanism

Worth stating plainly because it is so ordinary. Nobody decides to take the exemption away from a fire victim. The address changes, the system notices, a form goes out, and if it is not returned the exemption goes.

The remedy is equally ordinary: make sure redirected post is actually being read, and treat anything from the assessor as time-sensitive even when it reads like routine administration.

Can I Keep It If I Cannot Move Back?

Possibly, because the statute allows the qualifying occupant to be the owner, the owner's spouse, another family member or a tenant. A habitable house let year-round to a Utah-domiciled tenant can continue to qualify. Whether that works in your circumstances is a question for the county assessor, and it is worth asking before assuming displacement ends the matter.

The Provisions Behind the Tax Position

Article XIII section 3 of the Utah Constitution permits a 45 per cent exemption, implemented by section 59-2-103 of the Utah Code so that tax is paid on 55 per cent of value. It was enacted in 1982 at 25 per cent and raised to 45 per cent in 1995.

The occupancy test is 183 consecutive days. Section 59-2-103.5(8) allows 90 days to return a declaration, and some counties remove the exemption after 30 days from notice.
